Foxsmart Systems GmbH, operating as Unbiased Ventures, is a Swiss-based venture capital fund and assessment technology provider. These Terms govern your use of our website, including any materials you upload or submit and any psychological assessments you complete through our platform.
Disclaimer: Investing in early-stage startups is a high-risk asset class. Accredited investors who choose to invest in this asset class may risk loss of funds. Foxsmart Systems GmbH, operating as Unbiased Ventures, will not accept any investment proposals via this website. In order to invest in one of our funds, you should be personally acquainted with one of the managing partners and be fully aware of the risks involved. You may use our website solely for lawful purposes and in accordance with these Terms. You agree not to:
Startups and other users (“Uploaders”) may upload documents, pitch decks, business plans, or other materials (“Materials”) to the website.
By uploading Materials to our website, you expressly agree that:
You further agree that your Materials may be distributed, copied, or otherwise disseminated within our network of authorized third parties, including but not limited to consultants, analysts, and investors, to facilitate due diligence, analysis, and investment decision-making, for the period described in Section 3.2.
Materials uploaded to the website that contain commercially sensitive or proprietary business information will be handled with reasonable confidentiality by our team and authorized partners. However, you should not upload materials containing personal data of third parties (such as employees or customers) without first obtaining the necessary consents from those individuals.
Foxsmart Systems GmbH offers psychological assessment services under the Unbiased Ventures brand, including digital footprint analysis, direct psychological assessments, keystroke dynamics assessments, and team dynamics reports (collectively “Assessment Services”).
Participation in any Assessment Service requires your explicit, informed consent provided through the assessment platform at the time of the assessment. The collection and processing of assessment data is governed by a separate consent notice displayed before the assessment begins, which forms part of these Terms by reference.
Assessment responses, trait scores, and psychological profiles generated through the Assessment Services are retained for 24 months from the date of completion, after which they are permanently deleted, unless you request earlier deletion.
Assessments provided through this platform are not clinical psychological assessments, psychiatric evaluations, or medical diagnoses. Results should not be used as the sole basis for any employment, investment, or other significant decision about a person.
Where an assessment is commissioned by a third-party organization (investor, fund manager, accelerator), that organization acts as Data Controller and is legally responsible for informing the assessed individual of the purpose and legal basis for the assessment prior to its commencement. Foxsmart Systems GmbH acts as Data Processor in such cases, processing data strictly on the instructions of the commissioning organization under a signed Data Processing Agreement.
Nothing on this website, and nothing in any assessment result, report, or analysis produced through our platform, constitutes investment advice, a recommendation to invest or not invest, or a guarantee of any business outcome. Psychological trait profiles and pitch deck analyses are inputs to a broader due diligence process. No investment decision should be made based solely on any output of this platform.
You retain ownership of your Materials, but by uploading them, you grant Foxsmart Systems GmbH the rights described in Section 3. You confirm that you have all necessary rights and permissions to upload the Materials and that doing so does not infringe any third-party rights. Assessment methodologies, scoring algorithms, and report formats are the intellectual property of Foxsmart Systems GmbH and may not be reproduced without written permission.
Foxsmart Systems GmbH shall not be liable for any direct, indirect, or consequential damages arising from the use, analysis, or distribution of uploaded Materials, the results of any psychological assessment, or any decision made on the basis thereof.
We process your personal data in accordance with our Privacy Policy. Where you participate in an Assessment Service, processing is additionally governed by the consent notice provided at the time of assessment. Where applicable, EU GDPR takes precedence over any provision in these Terms that conflicts with it.
Changes to Terms: We may update these Terms from time to time. For material changes, we will notify you directly or display a prominent notice on the website. Continued use of the website after non-material changes constitutes acceptance of the updated Terms.
Governing Law: These Terms shall be governed by and construed in accordance with Swiss law. Where EU data protection law applies to any processing described herein, it takes precedence over any conflicting provision.
Dispute Resolution: Any disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland.
